Notice of Applications – 34T-AY22001, 34CD-AY2202 & ZBA05-22 – Part Lot 81, Concession North of Talbot Road East, Town of Aylmer (Geographic Township of Malahide)
PLEASE TAKE NOTICE that the Council of the Corporation of the Town of Aylmer has received complete Applications for a Draft Plan of Subdivision, Draft Plan of Condominium and Zoning By-law Amendment for Performance Communities Realty Inc. and Schipper Farms Limited and is hereby notifying the public in accordance with Sections 51 and 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended.
THE APPLICATIONS relate to the subject lands described as Part of Lot 81, Concession North of Talbot Road East, Town of Aylmer (geographic Township of Malahide). A key map showing the location of the subject lands, outlined in yellow can be found attached to this notice.
THE PURPOSE & EFFECT of the Application for Draft Plan of Subdivision proposes the following, as shown on the attached draft plan:
- 55 residential lots for single detached dwellings (Lots 10-38, 47, 48 and 51-74);
- 16 units for semi-detached dwellings (Lots 39-46);
- 70 row townhouse units (Lots 1-9, 49, 50, 75 and 76);
- 44 units for medium density residential (Block 77);
- the extension of Willow Drive;
- walkways/servicing blocks (Blocks 78-79);
- stormwater management area (Blocks 80-81);
- open space/park (Blocks 82-85);
- sanitary pumping station (Block 86);
- future road allowance (Block 87); and,
- temporary road turnaround (Blocks 88-89)
THE PURPOSE & EFFECT of the Application for Draft Plan of Condominium is to develop 1.38 ha (3.41 ac.) in area for 44 vacant land condominium townhouse units (Block 77 as noted above).
THE PURPOSE & EFFECT of the Application for Zoning By-law Amendment is to implement the Plan of Subdivision and Plan of Condominium by rezoning the subject lands from Residential Holding (RH), as shown on Schedule ‘A’ Map 4 in the Town of Aylmer Comprehensive Zoning By-law No. 57-99 to the following:
- Residential Type 2 Special Provision 20 (R2-20) to permit semi-detached dwellings with special regulations (Lots 39 to 46);
- Residential Type 3 Special Provision 9 (R3-9) to permit single detached dwellings with special regulations (Lots 10 to 38, 47, 48 and 51-74);
- Residential Multiple Second Density Special Provision 11 (RM2-11) to permit row townhouse units with special use regulations (Lots 1 to 9, 49, 50, 75 and 76);
- Residential Multiple Second Density Special Provision 12 (RM2-12) to permit vacant land condominium townhouse units (Block 77);
- Environmental Protection (EP) to permit stormwater management area and open space (Blocks 80 and 82-83)
Block 84 will remain zoned Environmental Protection (EP) and will be used for a park. A locational map of the property, including the proposed subdivision and condominium layouts are attached on the Key Map.
PUBLIC MEETINGS for the applications of the Draft Plan of Subdivision, Draft Plan of Condominium and Zoning By-law Amendment will be presented at a future public meeting. You will receive another notice inviting you to attend this meeting.
In accordance with Section 51(19.1) of the Planning Act, R.S.O. 1990, c.P13, as amended, the County of Elgin being the approval authority for draft plans of subdivisions and draft plans of condominium has deemed the applications for draft plan of subdivision and draft plan of condominium to be complete on November 28, 2022 for the purposes of Sections 51(17) and 51(18) of the Planning Act.
In accordance with Section 34(10.4) of the Planning Act, R.S.O. 1990, c.P13, as amended, the Town of Aylmer has deemed the application for Zoning By-law Amendment to be complete on December 1, 2022, for the purposes of Section 34(10.1) and (10.2) of the Planning Act.
OFFICIAL PLAN DESIGNATION for the subject lands are Low Density Residential and Parks and Open Space, as shown on Schedule “A” Land Use Plan in the Town of Aylmer Official Plan.
If a person or public body does not make oral submissions at the public meeting or make written submissions to the County of Elgin in respect of the proposed plan of subdivision and plan of condominium before the approval authority gives or refuses to give approval of the draft plan of subdivision and draft plan of condominium, or if a person or public body does not make oral submissions at the public meeting or make written submissions to the Town of Aylmer before the by-law is passed, the person or public body is not entitled to appeal the decisions of the County of Elgin and the Town of Aylmer to the Ontario Land Tribunal.
If a person or public body does not make oral submissions at a public meeting, or make written submissions to the County of Elgin in respect of the proposed plan of subdivision and plan of condominium before the approval authority gives or refuses to give approval to the draft plan of subdivision and draft plan of condominium, or if a person or public body does not make oral submissions at a public meeting, or make written submissions to the Town of Aylmer before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Written comments with respect to the proposed draft plan of subdivision and draft plan of condominium and rezoning may also be submitted to the Town of Aylmer at the address listed at the end of this notice.
