PLEASE TAKE NOTICE that the Town of Aylmer Committee of Adjustment will hold a virtual public hearing on Wednesday, March 2, 2022 at approximately 7:00 p.m. in a public livestream available at www.aylmer.ca, to consider Application for Minor Variance A03-22.

You are invited to participate in the public hearing to provide verbal or written comments regarding this matter.

Purpose and Effect of Application A03-22

The purpose of the application is to seek relief from Section 7(3) – Zone Requirements of the Residential Type 1B (R1B) Zone as it relates to minimum lot area, minimum front yard depth, and lot coverage, in order to fulfill a condition of severance approval (Consent E2‑22) and to increase the buildable area of the lot to be severed.

The Zoning By-law requires a minimum lot area of 500m2 (0.12 ac), a minimum front yard depth of 7.0m (23ft) and a maximum lot coverage of 35%. The applicants are requesting the following relief:

  • Minimum lot area of 365m2 (0.09ac) for the lot to be severed and a minimum lot area of 450m2 (0.11ac) for the lot to be retained;
  • Minimum front yard depth of 5.5m (18 ft) for the lot to be severed; and,
  • Maximum lot coverage of 40% for the lot to be severed.

Location and Description of Subject Land

The subject property is legally described as Part of Lots 11 and 12 N/S North, W/S Victoria, Plan 164 (Town of Aylmer), and is known municipally as 62 Victoria Street North, Aylmer.

The subject property is located within the Low Density Residential land use designation of the Town’s Official Plan and Residential Type 1B (R1B) of the Town’s Zoning By-law. All other provisions of the R1B Zone would continue to apply on the subject property.

ALSO TAKE NOTICE that signed, written submissions shall be accepted by the Secretary-Treasurer prior to the hearing and such submissions shall be available for inspection by any interested party.  If you do not attend or are not represented at the Hearing, the Committee may proceed in your absence, and you will not be entitled to any further notice of the proceedings. Copies of the decision are provided only to those persons making a written request for the Notice of Decision.

There is a 20-day appeal period from the date of the decision, in which time the decision of the Committee may be appealed to the Ontario Land Tribunal.
