Notice of Public Hearing – Minor Variance A06-24 – 187 John St N
PLEASE TAKE NOTICE that the Town of Aylmer Committee of Adjustment will hold a Hybrid (in-person and virtual) Public Hearing on Wednesday, December 4th, 2024, at approximately 7:00 p.m. to consider Application for Minor Variance A06-24 with a public livestream available at www.aylmer.ca. You are invited to participate in the Hybrid Public Hearing to provide verbal or written comments regarding this matter.

Purpose and Effect of Application A06-24
The subject lands are located within the Arterial Commercial land use designation of the Town of Aylmer Official Plan. The subject lands are also zoned Support Commercial (C2) in the Town of Aylmer Comprehensive Zoning By-law No. 57-99. The subject lands currently contain a vacant retail store and storage building that were formerly used as a building supply centre (outlined in yellow on the back of this notice). The owners intend to remove all buildings and structures and construct a 3 storey building with one (1) commercial unit on a portion of the ground floor and thirty-six (36) residential apartments on the remainder of the ground floor and the two floors above the ground floor.
The variance will permit relief from the following in the Zoning By-law:
- An increase in the maximum building height from 7.5 m (24.6 ft.) to 12.0 m (39.37 ft.) (as per Section 15(3)(j)) ;
- Residential use along a portion of Walnut Street and residential use along Murray Street (as per Section 15(3)(i)(i));
- Reduction in the parking area street line setback from 3.0 m (9.84 ft.) to 0 m (0.0 ft.) along Murray Street (as per Section 3(18)(g)); and,
- An increase in maximum fence height from 1.8 m (5.91 ft.) to 2.4 m (7.87 ft.) along the lot lines of 157 John Street North (from the front of the building to the rear), 11 Chestnut Street East and 89 Chestnut Street East (as per Section 3(8)).
Location and Description of Subject Land
The subject lands are legally described as Lots 5 & 7 E/S John, Lots 4, 6 & 8 W/S Murray S/S Walnut Plan 164, Town of Aylmer (geographic Town of Aylmer), and is known municipally as 187 John Street North, Aylmer. The location and proposed development are shown on the Key Map and sketch attached to this notice.
Any person or public body may attend the Hybrid Public Hearing and/ or make written or verbal representation either in support of, or in opposition to the Minor Variance. If you wish to attend the Public Hearing virtually, please contact the Manager of Planning and Development by email or by phone by no later than noon on December 4th, 2024, to receive an invitation to the hearing. Verbal representation for the Hybrid Public Hearing may be provided in-person or electronically. Written comments can be submitted by email to the Manager of Planning and Development or in-person to the Town Hall Office by no later than noon December 4th, 2024. Please note that comments and opinions submitted on these matters, including the originator’s name and address, become part of the public record, and may be viewed by the general public and may be published in a Planning Report, Council/Committee Agenda or Council/Committee Minutes.
If you rent your property to seven (7) or more tenants, please post a copy of this notice in a location on your property, which is visible to all the residents.
If a specified person or public body does not make oral submissions at the Hybrid Public Hearing or make written submissions to the Secretary-Treasurer of the Town of Aylmer Committee of Adjustment before the minor variance is granted, the specified person or public body is not entitled to appeal the decision of the Town of Aylmer to the Ontario Land Tribunal.
If a specified person or public body does not make oral submissions at the public hearing or make written submissions to the Secretary-Treasurer of the Town of Aylmer Committee of Adjustment before the minor variance is granted, the specified person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to do so.
