PLEASE TAKE NOTICE that the Town of Aylmer Committee of Adjustment will hold a virtual public hearing on Wednesday, January 12, 2022 at approximately 7:00 p.m., in a public livestream available at www.aylmer.ca, to consider Application for Minor Variance A01-22. You are invited to participate in the public hearing to provide verbal or written comments regarding this matter.

Purpose and Effect of Application A01-22

The purpose of the application is to seek relief from Sections 3(1)(c) Accessory Buildings and Structure Size Requirements within the Town’s Zoning By-law in order to facilitate the construction of an accessory building with attached lean-to structure in the rear yard of the subject property.

The provisions of the Zoning By-law indicate that the area of an accessory building or structure shall not exceed 75 m2 (807 sq.ft). The proposed accessory building would have an area of approximately 107 m2 (1,152 sq.ft) with an attached, unenclosed lean-to having an area of approximately 45m2 (484 sq.ft), for a total building area of approximately 152 m2 (1,636 sq.ft).

Location and Description of Subject Land

The subject property is legally described as Part of Lot 85, Concession South of Talbot Road (Town of Aylmer) and is municipally known as 140 Elk Street.

The subject property is located within the Low Density Residential land use designation of the Town’s Official Plan and Residential Type 1B (R1B) Zone of the Town’s Zoning By-law. All other provisions of the Residential Type 1B Zone would continue to apply on the subject property.

ALSO TAKE NOTICE that signed, written submissions shall be accepted by the Secretary-Treasurer prior to the hearing and such submissions shall be available for inspection by any interested party.  If you do not attend or are not represented at the Hearing, the Committee may proceed in your absence, and you will not be entitled to any further notice of the proceedings. Copies of the decision are provided only to those persons making a written request for the Notice of Decision.

There is a 20-day appeal period from the date of the decision, in which time the decision of the Committee may be appealed to the Ontario Land Tribunal.
